Wala bang kapangyarihan ang isang electric distributor, tulad ng Manila Electric Company (Meralco) o isang kooperatiba, ang basta-basta na lamang puputol ng serbisyo ng isang consumer na pinaghihinalaang nagnanakaw ng kuryente o gumagamit ng “jumper”?
“Wala,” ayon sa Korte Suprema, base sa desisyon nitong katigan ang unang desisyon ng Court of Appeals na pagbayarin sa danyos ang Meralco dahil sa pagputol ng serbisyo ng kuryente sa Permanent Light Manufacturing Enterprises noong 1994 na walang paunang abiso.
Sa desisyon na isinulat ni Justice Martin Villarama Jr., sinabi ng Supreme Court na mahalagang batas sa pagpuputol ng kuryente ay Section 4 ng Republic Act No. 7832 na nagpapataw ng multa sa mga nagnanakaw ng linya ng kuryente at iba pang materyales.
Saad nito na sa ilalim ng RA 7832: “In order for the discovery of a tampered, broken or fake seal on the meter to constitute prima facie evidence of illegal use of electricity by the person who benefits from such illegal use, the discovery thereof must have been personally witnessed and attested to by an officer of the law or a duly authorized representative of the Energy Regulatory Board (ERB).”
“Even when the consumer, or someone acting in his behalf, is caught in flagrante delicto or in the act of doing any of the acts enumerated in Section 4 of RA 7832, Meralco may not immediately disconnect electricity without serving a written notice or warning to the owner of the house or establishment concerned,” hayag ng SC.
“Absent any showing that an officer of the law or a duly authorized representative of ERB personally witnessed and attested to the discovery of Permanent Light’s tampered electric meter (as testified to by Meralco’s employees), such discovery did not constitute prima facie evidence of illegal use of electricity that justifies immediately disconnection of electric service.”
