Pilipinas, nasa piracy watch list pa rin ng United States

KABILANG pa rin ang Pilipinas sa listahan ng mga bansang itinuturing ng United States na notoryus sa intellectual property (IP) piracy.

Sa Special 301 Report ng U.S Trade Representative (USTR), nananatili sa “watch list” ang Pilipinas kasama ang 29 pang mga bansa dahil sa “significant concern” sa paglabag sa IP rights (IPR).



“The United States looks to the Philippines to take important steps to address piracy over the Internet, in particular with respect to notorious online markets,” saad sa ulat.

Binigyang diin din ng USTR ang pangangailangang palakasin ang “criminal enforcement” ng intellectual property rights at pagbutihin ang “predictability with respect to search and seizure orders.”

Sinabi ng USTR na nangangailangan din ng review ang mga batas na naglilimita sa “patentability of certain chemical forms unless the applicant demonstrates increased efficacy.”

Hinihikayat din ang Pilipinas na pagbutihin ang proteksiyon laban sa unfair commercial use at unauthorized disclosure ng tests at iba pang data sa pharmaceuticals at agricultural chemical products.

Gayunman, pinuri ng USTR ang mga pagsisikap ng mga opisyal at mambabatas na palakasin ang proteksiyon at pagpapatupad sa IPR sa Pilipinas.

Partikular nitong binigyang diin ang amendments ng Intellectual Property Code upang maging consistent sa World Intellectual Property Office Internet Treaties.

Tinukoy din ang bansa sa patuloy na pagbabas sa insidente ng “unauthorized camcording of motion pictures in theaters.”

Regular na nasa USTR watchlist ang Pilipinas simula nang alisin ito sa priority watch list noong 2006.

Ang iba pang bansa na nasa watch list ngayong taon ay Barbados, Belarus, Bolivia, Brazil, Bulgaria, Canada, Colombia, Costa Rica, Dominican Republic, Ecuador, Egypt, Finland, Greece, Guatemala, Israel, Italy, Jamaica, Kuwait, Lebanon, Mexico, Paraguay, Peru, Romania, Tajikistan, Trinidad and Tobago, Turkey, Turkmenistan, Uzbekistan at Vietnam.

Napabilang naman sa “priority watch list” ang 10 bansa: Algeria, Argentina, Chile, China, India, Indonesia, Pakistan, Russia, Thailand, Venezuela.

“Countries placed on the Priority Watch List are the focus of increased bilateral attention concerning the problem areas,” sabi ng USTR.

Ang ulat ay resulta ng mga deliberasyon ng US state agencies at konsultasyon sa US Congress, foreign governments at iba pang partido.
